Southern District Federal Court Summary Judgment for Statutory Employer
On Feb. 21, 2019, Hugh Gillon obtained a summary judgment in a multi-party case arising from a work place accident wherein the employee of his client’s subcontractor was injured. The Plaintiff was injured when attempting to move the forks on a forklift being used on the jobsite. The court held that Mr. Gillon’s client was a statutory employer such that the Plaintiff’s claims against his client were barred by the exclusivity provisions of the Mississippi Workers’ Compensation Act.
