Jury Verdict for OB/GYN in Robotic Surgery Suit

On January 17, 2020, Tommie Williams and J.L. Wilson obtained a jury verdict in favor of a GYN surgeon in Oxford, Mississippi.  Plaintiffs requested over $800,000.00 in damages based on allegations that a patient’s ureter was injured during a robotic assisted laparoscopic surgery.  

Plaintiff claimed that the surgeon was negligent and had inadvertently transected her ureter.  The defense presented expert testimony in the fields of gynecological surgery, robotic surgery and urology.  Through these experts, the defense showed that the surgeon complied with the standard of care at all times, that the injury was a recognized complication of the procedure and that the surgeon did not cause or contribute to any injury of the plaintiff.  After 5 days of trial, the Lafayette County jury returned a verdict for the GYN surgeon and no appeal was taken.
